Mealmyday.com service terms and conditions (since 01/2015 )
This document is a legally binding agreement between the customer and mealmyday.com service offered by Meal My Day Ltd. It controls how the customer can use the provider’s web service and what are the responsibilities of the service provider to the customer. These terms and conditions must be read carefully before using the service.
The service aims to develop the service and to enable uninterrupted operation. The Service Provider has the right to modify or delete parts of the service or its content, structure, service times, or other service issues. If the changes require changes to the customer's hardware or software, or other action by the customer, the service provider shall endeavor to inform the changes well in advance. Customer is responsible on his/her own expense for the necessary changes of the devices and IT software.
Service delivery and use
The service is, in principle, available 24 hours a day, unless a different time of availability for a certain service is reported. The service provider does not give any direct or indirect guarantee of the functioning of service or its traits and does not guarantee that the service will always function and run error-free. The Service has always the right to without compensation terminate provision of the service, in whole or in part, as well as the right to temporarily take down the service or a part of it for maintenance or other reasons.
The service provider may, if considered necessary, without prior notice prevent the customer to access the service and / or receiving the service.
Use of Mealmyday.com service
The customer receives a restricted license to the service according to the terms of service. The customer receives the service and uses it at his/her own risk. Customer is responsible for the purchase, installation, maintenance and costs of the hardware, software, telecommunications and data transmission acquisition required in using of the service. The customer may not combine or use the service in such a way that it causes undue stress or other harm to the network, the network connection to other networks, service users, other third parties or the service provider. The service provider may provide more detailed instructions about the network load and unpermitted use. Use of certain components of the service requires registration. The administration has the right to intervene in the apparent misuse situations.
Service Provider complies with the Finnish Personal Data Act (523/1999) in processing of personal data and registration. The service provider uses customer personal information primarily to offer free and pay services included in the e-services to the user, but can also provide other services. The user shall give the service provider the necessary and correct personal and other information required in using the service. The customer, who uses the published contents of the service, contacts are, in principle, confidential information that Service Provider will not disclose to a third party.
The service process the user's personal data in relation to the service provided, in response to user inquiries sent and feedback , to improve the products and services, for statistical purposes, as well as other customer relationship management purposes. The service provider can use the supplied personal data for marketing purposes according to the Personal Data Act.
User right of prohibition, correction and inspection
The user has the right to forbid the disclosure and handling of personal information for direct advertising, telemarketing and other direct marketing. The user has the right to inspect the register of the personal data relating to the Personal Data Act. Inspection is free of charge once a year. User's request, the service provider will correct, delete or supplement without undue delay, the purpose of reading incorrect, unnecessary , incomplete or outdated personal data. Conclusion of the agreement and the purchase of service
When the customer presses the " Purchase or " button and ticks the "I accept these terms and conditions " - check box when registering on the service page, the customer confirms that they are over 18 years old or that they have a permission of a parent or a guardian to enter into an agreement. At the same time, they undertake to comply with the terms of this Agreement. All customer information provided at time of registration must be correct and must not be lacking with essential information. The customer has the obligation to keep such information up to date and update them if necessary. When a customer chooses the service by ticking the check box and clicks on the "Buy Now" button on mealmyday.com pages, they agree to pay for the price of the service. The customer chooses the payment method. If the customer pays with a debit or credit card, and allows charging of the debit or credit card, the customer confirms that they have the right to do the purchase, and that they are the holder of the card (the card is in the name of the customer). All mealmyday.com website reported prices include VAT (if there is a product on which VAT is paid), and other applicable taxes and fees. The agreement is either valid for a period, or the service provider terminates it. The termination will become effective when the ongoing, already paid subscription period has ended. Service Provider reserves the right to terminate this Agreement and close the customer's account at any time if the customer misuses or is suspected of misusing the service. If the service provider terminates this Agreement or closes the customer account to something other than the above mentioned reasons, the service provider shall not be responsible or liable for the customer to compensate any paid fees.
Service Provider has the right to from time to time change the prices of paid services. Price changes are effective as of the current payment period expires (i.e. at the end of the period, of which the client has already paid for). the customer will be notified of all the price changes. If the customer does not agree to changes in the price of the service, they are entitled to terminate the service subscription. Customer shall be deemed to have accepted the new price if the customer continues the use of mealmyday.com pay service after learning of the price changes.
Right of cancellation
Mealmyday.com service cannot be cancelled, accepting these conditions will lead to the obligation to pay.

The Service Provider is not responsible for any indirect damages. The Service Provider is not responsible for the readymade or customer made nutritional plans, for example, the functionality of the plans for weight management.
Service Provider is not liable for any damage caused by force majeure or other reasons leading to excessive difficulties in functioning.
Compensation for damages shall be required from the service provider within one month after the customer discovered or should have discovered a criterion for compensation. The service provider's liability for any damage is always limited to a maximum of the service fee paid by the customer for the damaged service. Customer is responsible for use of the service, and the information they leave to the service or share with other users, and in other information networks. The customer is responsible for ensuring that the use of the service, or the above-mentioned material does not violate any third party's copyright, and other intellectual property rights. The customer is responsible for ensuring that the use of the service does not violate the terms and conditions or any special conditions, the law or etiquette, or cause harm or disruption to the network service provider, the service provider contract partners, to other users of the service or other third parties. Customer agrees to pay compensation to the service provider or a third party for any damage caused by the customer.
The Service is provided "as is" and "as available". Permitted by law Service Provider does not grant express or implied warranty for services or products, their quality, content or suitability for a particular purpose. Service Provider does not guarantee, support or take responsibility for any product or service advertised or offered by a third party on the site, or advertised on banners or the linked web pages. The Service Provider is not in any way responsible for the transactions between the customer and the third party advertising services or products on service provider’s website. As with any other, or in any of the acquired product or service, the customer should use their best judgment and be careful. None of the information provided orally or in writing by the service, does not constitute a warranty from the service provider.
Rights to the service and the material included in the service
Copyright, intellectual property rights and other rights to the appearance and any materials on the service are protected by the Service Provider or its contractual partners. The Service Provider has the right to, free of charge, use and re-publish or pass forward, in modified or in original form, in whole or in part, and / or connected to another material, material produced, shared or transmitted by the customer via the service to any public area (such as Facebook, Twitter, Instagram, in business, the Media, public relations, or other activities. Other than within these Terms and Conditions and the Copyright act the customer is not permitted without a prior written consent from the Service Provider to reproduce, communicate to the public, publicly present, distribute to the public, publicly display or use the Service or content received through the service. The customer may not use the Service violating copyright or other rights of the service provider or a third party. The service provider does not return the material, such as pictures or writings, that the customer has solicited or unsolicited submitted to the Service Provider. The author is responsible for the content of their text.
Permitted and prohibited linking to the service website
The customer has the right to place a link to the main page of the service www.mealmyday.com on their own website. Other single page linking in commercial or economic purposes or to produce a database is prohibited without the prior written consent from the service provider.
In addition, be pointed out that the customer may not (without exception):
1. Copy, reproduce, transfer to copy, publish or otherwise use any part of the Service or its content (including nutrition plans, videos, pictures and texts) in a way that is not expressly permitted in this Agreement;
2. Give the password to any third party or use another person's user name or password;
3. Reverse engineer, disassemble, modify, or use the service or its parts to create software that imitates the service;
4. Circumvent any content protection technology used by the service or its licensors;
5. Rent or lease a part of the service;
6. To use the services in a manner that violates this Agreement;
In addition to the above, the customer agrees to take reasonable care to ensure that the service and its content are not used without permission.
Privacy and Security:
The customer is aware that the open data network includes a security risk. The service aims to organize the privacy and security of its information systems generally acceptable, and to prevent unauthorized access to information systems. The Service Provider is not responsible for the information security of the customer using the service. The customer is responsible for the protection and data security of the computers, computer systems, local area network or other similar devices or systems that using the service requires. Customer is responsible for the consequences of insufficient protection and for damages caused to the Service Provider, users or third parties by viruses, and other similar damage, entering the network and spreading through the network due to negligence of the customer.
Processing of personal data
The service provider process the personal data of customers registered according to register of service and data protection and privacy legislation.
We may collect personal information when a visitor registers as a service user, participates in contests or if the visitor otherwise sends us personal information via our website. Unless otherwise stated in the Service or in competition, personal data are processed for purposes related to the service provided or activities on our website, such as to resolve a competition or to respond to a visitor's request for information, as well in the development of products and services and in statistical purposes. In accordance with Personal Data Act § 19 personal data may also be used and disclosed for direct marketing purposes unless the visitor has prohibited the use of their data for direct marketing. Direct Marketing Prohibition and changes in the contact information may be reported by contacting us. If the visitor sends another person’s data to the service, or if they are under 18 years old, they must ensure that they have the person’s or guardian's consent to these terms and conditions in accordance with the purpose of use.
Third parties can be used for processing of data, to whom the data can then be transferred on our behalf. Other data processing requires the consent of the registered customer or is based on the law by express provision.
Personal data security and the security level of handling the data is implemented by the service provider according to necessary reasonable appropriate measures.

Validity of the terms
These terms and conditions are put into operation 01/2015 and are valid until further notice.
